FAYETTE FLYERS RADIO CONTROL BY-LAWS
- Purpose:
To further the Hobby/ Sport of radio controlled model aviation in Fayette
County while striving to provide a safe and appropriate flying site and a
suitable meeting place for club members and to aid and assist persons
expressing an interest in the area of model aviation.
Objective:
To provide sufficient organization in an effort to insure safety of persons
and property in compliance with the requirements of all governing bodies
involved with the operation of this club and its flying site while pursuing the
Hobby/Sport of Radio controlled model Aviation.
III. Requirements for Membership:
Membership will be unlimited in number. All members shall have equal
rights, privileges and responsibilities. Prospective members must be present
or be sponsored, by a club member in good standing, at a regular club meeting
and receive a affirmative majority vote to become a member.
- Must read, understand, and abide by the By-laws. Safety Rules and Field
Rules of this club.
- Must hold a current membership in the Academy of Model Aeronautics (AMA).

- The new AMA Park Flyer membership has been
authorized for use. The limits of the Park Flyer AMA membership MUST be
adhered to at all times. The rule is you may fly any airplane 2 lbs. or
less that is NOT Gas or Glow, and will not fly faster than 60 mph. ALL
Field rules and Safety rules apply the same as for a normal AMA member.

- Dues will be $50.00 each year for individual or family
regardless of age.
- A family is defined as those persons related by
marriage, blood, or adoption and residing in the same residence. All renewals
must be paid by December 31st. A late fee of $10.00 will be added after
January 1st. After March 31st the member will be removed from the roster their
slot will be made available to the next on the waiting list if any.
Persons who have not renewed their membership by the December 31st. deadline
above shall loose voting and field privileges until they render proper
payment.
- An invited flyer may fly up to four (4) times within a single contiguous
four (4) month period as the Guest of a Fayette Flyer Club Member. Any
exception will be made at the discretion of the Executive Council. After four
(4) visits the guest must present himself or herself at a regular club meeting
(or be sponsored by a club member in good standing) as a candidate for club
membership or make other arrangements for future flying. The Host member
must be present with his guest at all visits. The Host shall confirm
current AMA membership by reviewing the guest's AMA card or other PROOF of AMA
coverage prior to the first flight. The Host will further be responsible to
inform the guest (s) of the frequency control system, the posted field rules
and the No Fly zones. Hosts should inform their guest (s) of any safety rules
violations during the flying session.
IV. Club Officers:
- All officers have voting privileges. However, since the President (or his
designee) presides over all meetings in the role of moderator / chairman, the
President or his designee, shall vote only if a question results in a tie. At
that point the deciding vote may be cast.
- Any officer may discuss any issue and express an opinion in meetings or
privately just as any other club member. Officers shall not, however, speak
for the club without prior club authorization. All elected officers shall be
afforded dues free membership for the year (s) he or she serves in office.
- President:
will preside over monthly meetings, called meetings,
and fill officer vacancies by appointment from the club roster.
- Vice-president:
will serve in the absence of the President. He
will discharge responsibilities as delegated or assigned to him by the
President.
- Secretary:
is the liaison between the Club and AMA governing Body,
keeps minutes of all meetings and maintains a roster of club members.
- Treasurer:
receives all monies associated with the club. Furnishes
Quarterly statement at the regular monthly meeting for Audit by three (3) Club
members.
V. COMMITTEES:
There shall be six (6) standing committees and appointed chairmen as
deemed necessary by the elected officers.

- Contests
- Youth Activities
- New member / training
Safety officer
Public affairs: This Committee shall be responsible to inform the
membership and the general public of up coming club events. This may be done
through The Fly Paper, and/ or news media such as printed flyers, free
newspaper articles, radio and TV time if available. The Chairman may, at his
or her discretion, use appropriate signage to direct participants and/or
spectators to club events. This committee will furnish pertinent Club activity
information to District V vice president of the AMA. The Chairman may enlist
assistance from other club members as needed. The Chairman may request funds
to promote club-sponsored events. The executive committee prior to the
expenditure must approve any such monetary requests.
The Newsletter Editor/Webmaster shall
publish The Fly Paper each month. The membership is encouraged to furnish
technical information and news articles for publication in The Fly Paper. In
order for information to be published in the next issue of the newsletter it
must be in the hands of the Editor/Webmaster no later than the 21st. of the
current month . The Editor/Webmaster shall post the Newsletter to the Web Site
by Monday of the week in which the next regular meeting will be held.The Contest Director is responsible for all AMA sanctioned events.
These AMA sanctions exist to promote national standards. He or She will assure
adherence to AMA regulations in sanctioned events and clearly spell out in
advance any deviations.
- The Contest Director is granted specific authority relating to organization,
rules and safety. In addition, the CD at an AMA sanctioned event has the
authority to perform safety inspections of any equipment and to prevent any
participant from using equipment, which, in the CD's opinion, is deemed unsafe.
Furthermore, the CD shall have irrevocable authority to disqualify or prevent
from flying any participant whose ability to fly is, in the CD's opinion,
impaired by the use of alcohol or drugs.
- The Youth Activities Chairman
shall encourage participation of young
people in model aircraft activities through possible building, training, and
flying sessions. He or she should work with and through local school systems
where possible. The Chairman advises the Club of Youth events and may enlist
club members for assistance and request club financial support for Youth
Programs.
The New Member / Training Chairman will receive new member
applications from prospective members and introduce the prospective members to
the club. The club Secretary will receive initiation and dues monies. The New
Member/ Training Chairman will present the candidates to the club for voting
procedure. The Chairman will furnish new members with information concerning
field and safety regulations and will assist student pilots by providing a
list of instructors and insight about how to obtain a flight instructor. It is
expected that the student will fit his or her schedule to that of the
instructor. The Chairman may elect to suggest specific times and days to the
club, which might be designated " Training" Sessions when instructor pilots
will be present. The instructor is not expected to furnish any supplies such
as the plane, radio equipment, fuel, props, batteries, etc. Instructors will
not be responsible for damage incurred by student’s planes and /or equipment.
No training will take place on Sundays after 12:00 noon.
The Safety Officer The person chosen for this position needs to be
mature, knowledgeable, and able to express himself / herself before an
audience as well as on a one-to-one basis. He or she shall serve as chairman
of the safety committee that is composed of the chairman and two (2) or three
(3) members that the chairman shall select in concert with the elected
officers. All shall have equal duties / responsibilities but the Chairman have
final authority and shall be the spokesman for the committee.
Duties include:
1.Pre-flight inspection of all new aircraft
2.Pre-flight inspection of all repaired aircraft
3.Analysis of causes for any crash, pilot error included
4.Preperation of Club field rules
5.Enforcment of AMA safety rules.
6.Right to prevent individual fliers from flying if their conduct or aircraft
is not suitable
7.Supervision of spectator areas
8.Supervision of flight line and frequency control
9.To know address and shortest route to hospital, police, and fire department
10.To know location of field fire extinguisher
11.To know names of persons qualified in first aid CPR, etc.
12.Conduct of safety classes as part of regular meetings
- The president may appoint other ad hoc committees deemed necessary for the
orderly operation of the organization.
The Executive Committee: is made up of the Club officers and is the
Board of Directors of the Corporation.

The
Executive Committee shall propose to the membership, a budget to be voted on,
by the November meeting of each year. This budget shall include the coming
years’ expected operating expenses as best as can be determined by the
committee. During the year, any expenses over the sum of $100.00 and not
included in the budget, will be submitted to the membership for approval.
Election of Officers:
Nominations for Club Officers will be made at the regular club meeting in
October.
- Election of Club Officers will be at the regular Club meeting in November
and will be by a majority vote of members present and voting.
- Officers elected will assume office in December.
VI. Safety Rules and Regulations:
Under no circumstances will any member, guest, or spectator allow any
alcoholic beverage on the site inside the gatepost at the entrance to the
field.
- AMA Safety Code, all posted Field Rules and Club Safety Rules must be
followed in all instances.
- All club members are in effect Safety Officers and will assist in
eliminating unsafe conditions.
VII. DISSOLUTION:
1. The Corporation may be
dissolved with the approval of a two-thirds (2/3)-majority vote of the total
membership.
2. Upon the dissolution of the
Corporation, the Board shall, after paying or making provision for the payment
of all of the liabilities of the Corporation, dispose of all the assets of the
Corporation exclusively for the purposes of the Corporation in such manner, to
the Academy of Model Aeronautics, Inc., or to such other organization or
organizations organized and operated exclusively for charitable, educational,
religious or scientific purposes as shall at the time qualify as an exempt
organization or organizations under Section 501(c)(3) of the Internal Revenue
Code of 1986, as amended, or to such other organization with purposes similar to
the purposes of this Corporation, as the Board shall determine. Any of such
assets not so disposed of shall be disposed of by the Court of Common Pleas (or
similar court) of the county in which the principal office of this Corporation
is then located, exclusively for such purposes and to such organization or
organizations, as said court shall determine, which are organized and operated
exclusively for such purposes.
VIII. RESIGNATION, TERMINATION, DISCIPLINARY ACTION, EXPULSION
AND REINSTATEMENT OF MEMBERSHIP:
1.
Any member in good standing
may resign his/her membership by giving written notice to the Club.
2.
If any member ceases to have
the qualification necessary for membership in the AMA, his/her membership in the
Club shall thereby terminate, subject to reinstatement upon restoration of
eligibility.
3.
This section provides for
enforcement of the Safety Rules that are related to flying activities. Any other behavior by an individual member or members, as
deemed unacceptable by the
Board of Directors, become the responsibility of the Board of Directors as
stated. Any individual may be expelled from membership from the Club by a
two-thirds (2/3) majority vote of the Board of Directors if, in the Board of
Directors’ determination, such individual willfully commits any act or omission
which is a violation of any of the terms of these Bylaws, or the Rules of the
AMA, or which is detrimental the Club, the AMA, or to model aviation.
4.
Any member who is expelled
from membership may be reinstated to membership after a one year expulsion only
by two-thirds (2/3) majority affirmative vote of the Board of Directors.
5.
The Board of Directors shall
have the discretionary authority to provide for and to impose disciplinary
action for such acts or omissions, which do not justify expulsion from
membership.
IX. Grievance Policy:
1. Purpose
The grievance procedure provides a mechanism to enforce existing
safety rules and field rules by providing a progressive disciplinary system when needed.
Although most complaints can be resolved informally, if a complaint is serious
or cannot be resolved informally, the matter should be referred to the Safety
Committee for its consideration by means of a Grievance Form to be filled out
and turned into the Safety Committee Chairman. At least one witness to the
offense is required
to sign the Grievance Form.
2. Safety Committee
The Safety Committee shall use its judgment in carrying out
action on the following:
(a) A grievance form (copy attached at bottom of page) will be filled out and turned
into the Safety Committee Chairman. At least one other witness to the offense is required.
(b) FIRST VIOLATION
a. Viewpoints of both complainants and accused will be
considered.
b. Complainant’s name will be disclosed.
c. If the complaint is found to be valid a verbal reprimand will be given to the accused by the Safety
Committee, and this will be recorded in the Committee files.
(c) SECOND VIOLATION
a. Complainant’s name will be disclosed.
b. The accused has the right to a written rebuttal, to be
reviewed by the Committee.
c. If the Committee so decides in favor of the complainant, the flying privileges of the
accused will be suspended for thirty (30) days. Written notice of this shall be
issued and a copy published in the Club newsletter.
(d) THIRD VIOLATION
a. Upon the third verified violation the Committee will notify the accused in writing and the Club
members via the Club newsletter that the Club will vote on the expulsion of the accused at the next meeting.
b. Said expulsion will last for a one-year minimum. (Longer if deemed necessary by the Executive committee).
c. A member may be expelled from the Club only upon a two-thirds
(2/3) majority vote of the membership present and voting at the meeting.
d. Voting will be by secret ballot at a regular monthly meeting.
e. The expelled member may reapply for membership after the
expiration of the expulsion time period.
f. The third action will not be enforced unless there are
three accumulated violations within a two-year period of time.
g. Any member receiving a Grievance, who directs any
retaliation action against the person filing said Grievance, will be subject to
immediate expulsion from the Club. This is to include threats, intimidation,
physical harm, intentional equipment damage, or any other action deemed to be
retaliatory by the Board of Directors.

X. MISCELLANEOUS:
Frequency Control:
All transmitters will have a clearly marked plaque
affixed to the antenna along with proper colored wind streamer, properly
identifying the operating channel of the transmitter, in keeping with AMA
radio control utilization plan Part 2 and 3 paragraphs ( 2.2 thru 3.2.)
Upon arriving at the flying site, those members wishing to fly shall
review the frequency control board prior to removing any equipment from their
vehicle. If the desired frequency is open, the member should , at that time,
select the numbered pin that corresponds to this channel and clip it on his
transmitter antenna, making certain that the two numbers are identical. The
member also shall clip his current AMA card to the same frequency peg on the
board.
The above action will:
Display the member’s current AMA card.
Identify the flyer on any specific channel.
- Members who bring more than one transmitter are cautioned to carefully
select the proper pin for each transmitter.
- Members who will be flying on multiple frequencies are urged to "pin" only
one transmitter at a time.
- Upon completion of flight, as a matter of courtesy to others wishing to
fly, members should either remove their AMA card and replace the Frequency pin
on the board, or ask other members if they are waiting on channel "such and
such"
.
In the unfortunate event of a frequency violation that results in the
damage or destruction or a plane or property damage and/or personal injury,
the unpinned or improperly pinned pilot shall be considered in error, and
restitution to the offended pilot is the responsibility of the offending
pilot.
The Fayette Flyers organization will not assume, nor be put in the
position of mediator or referee in such cases. It shall be the responsibility
of the parties involved to resolve the issue in a fair and reasonable manner.
The extent of the involvement of the Fayette Flyers organization will not
exceed possible withdrawal of membership should the offending party/parties
fail to conduct themselves in an honorable manner.
- Instructors will be responsible for the proper pinning of transmitters for
any students they may be assisting.
- All transmitters operating on channel 00-60 will be of the narrow band
type. All transmitters sold as new on or after 3/1/93 are narrow band.
Transmitters displaying an R/CMA AMA gold sticker are narrow band.
Transmitters manufactured after12/31/94 will no longer have a gold
narrow band sticker.
- Each member shall be responsible for any property damage or personal
injury he or his aircraft may cause. Any damages caused by a minor member
shall be the responsibility of the minor member parent' (s) or guardian. The
group will not be jointly responsible for any damages caused by any
individuals of this group.
- Any complaint that is filed against the operation of the Club shall be
made in writing to the Executive committee and will be disposed of by that
group in a closed session within fifteen (15) days.
- All motions that propose a change to the By-laws will be voted on at the
next regular meeting following the meeting in which the motion is made and
will be posted in the Flypaper prior to the vote.
- By-laws may be amended by a majority of members present and voting at a
regular meeting or a special meeting of the Club. All actions supported by an
affirmative vote shall be effective at the time of ratification. All
amendments and / or changes to the by-laws shall be posted in the Fly Paper on
the web site within 30 days of ratification as information to the membership.
- Any member of the Executive Committee may call a special meeting of the
Club and at least three (3) executive members must be present.
